The family of Eric Garner has reportedly refused the offer of a $5 million settlement from the City of New York.

According to the New York Daily News, Esaw Garner, Eric Garner’s widow, turned down the city’s offer last week.

The family’s attorney, Jonathan Moore, urged the family to take the settlement, which would have been one of the largest settlements related to an New York Police Department-related death.

The Daily News cites sources close to the negotiations between the family and Controller Scott Stringer.

“In the gamut of wrongful death cases it’s a very substantial offer,” said one civil rights lawyer, who said that the law restricts the amount recovered in wrongful death cases.

Moore had suggested to the family that they take the settlement and push for more money in another lawsuit, this time against the paramedics who allegedly failed to give Garner necessary medical treatment.

The Daily News reports the family intends to sue the city for $75 million dollars.
